HotAir.com hypothesizes that he was actually referring to the bible instead of the Constitution. Maybe so, because if Bush had said this, the press would have crucified him.

I had to confirm that He actually said this! Just like He’s been to all 57 states. This is the smartest President we’ve ever had?
Can’t believe some of the incredibly silly things coming out of Washington. The SCOTUS nomination itself just derailed important attention from North Korea’s nuclear and missile tests. Obama decided he didn’t want to deal with DPRK and international issues, so he kept to his schedule in nominating another activist liberal judge to the Supreme Court.
Team Obama and his allies in the media had some silly things to say about the Sotomayor pick. (you can see a top ten list at: http://firstconservative.com/blog/political-humor/political-humor-the-sotomayor-season-of-silly-statements )
He concealed Sotomayor’s activist tendencies in her personal story. The media lapdogs gobbled up the personal story and haven’t really investigated her judicial philosophy. But… at least Obama – the smartest man in America – has faith in her.
