Fifth Circuit blocks ATF ban on bump stocks. It’s amazing what can happen when you don’t get a bunch of sissified leftist Obama judges ruling on things. This is a trend that needs to continue.

In this particular case, known as Cargill v. Garland, an en banc panel on the Fifth Circuit agreed 13-3 with the argument that the ATF’s sudden declaration that bump stocks were “machine guns” not only reversed years of settled policy, but completely ignored the meaning of the phrase “machine gun” as defined by the Gun Control Act and National Firearms Act.

  • Not a fan of bump stocks, although I admit I have never used one, but the ban was unconstitutional to begin with.
    But then,so are ALL the firearms laws on the books.

    • I just watched that Kevin Costner movie about the two ex-Texas Rangers that the governor hired to run down Bonnie and Clyde, a true story, and I was struck by the scene where Costner walks into a gun shop and arms himself for the chase. He has no badge, the Rangers have been disbanded, so as far as the gun shop is concerned he's just a guy off the street. He starts pointing at shit and saying, "I want that, let me see that," etc., including machine guns and you name it. A good percentage of what he purchased would probably be illegal now. It's a hilarious scene. When he's done he has about a dozen firearms on the counter and then he starts ordering ammunition. They help him carry his purchases out to the car and he just dumps it all in the back seat and heads down the road. That was America less than a century ago.

      • Yeah, I remember seeing cool stuff in gun ads in the 1960s. You could mailorder. My dad was a Chevron dealer. Back then they got points for sales and at the end of the year, they got a catalog. One year he got me a Remington 742 in 280 Remington. I forget if it arrived by mail or UPS.
