According to FindLaw, “Minnesota isn’t a stand your ground state. Rather, it’s a duty to retreat state which means that you must back away from confrontation if it’s possible. The state doesn’t have a castle law per se, but it does recognize the principles of the doctrine because Minnesota law allows you to use deadly force, including shooting an intruder, to prevent a felony from occurring in your home.” That site defines duty to retreat as “If the defendant isn’t in their home, Minnesota’s self-defense law requires a ‘duty to retreat’ before using deadly force, but only if retreat is possible and it doesn’t put the person into more danger. Deadly force isn’t authorized (outside of the home)

  • Funny how different things are here in Texas.
     
    My neighborhood is very active on the Nextdoor app. One of my neighbors was reviewing his security cam footage and saw a guy, wearing a mask, lurking around his house, . This occurred at 330AM. So the guy posts a screenshot and tells us to lock up, be careful to call the sheriff if they see the guy lurking on their property.
     
    Most of us have gated driveways, fences and property sizes that range from 4 to over 10 acres. Most of our homes are set back 30 to 300 yards from the street. If you're within 20 feet of my house, you've jumped a pipe fence or popped the gate and walked about 70 yards up my driveway. You're a danger to my family at that point and at my mercy.
     
    The ensuing posts on Nextdoor are pretty one-sided in response. Most of my neighbors WANT this guy to come on their property so they can take care of the problem themselves.

  • That’s what the law is in Hawaii, too. You have a duty to retreat and have to prove you couldn’t. BS. Your property. You have the NATURAL & CONSTITUTIONAL right to defend.
