Okay, I think the link above provides a very confused summary of what the appeals court ruled. The suit against NRO was a side issue. They did NOT dismiss the main suit against Steyn and CEI:

I read they just dropped NRO, not Stein. He also has a suit in Canada against Dr. Tim Ball. I believe in all cases he's dragging his ass and trying to get out of putting his data on the court record. Probably a good reason for that.
I predict Mann will drop the remaining action against Steyn and Simberg because he's deathly afraid of what would happen if he ever had to testify under oath. Unfortunately for Herr Professor Mann, Steyn filed a countersuit and he no intention of dropping it. Eventually Mann is going to be forced to eat his hockey stick.

Mann has been stalling unconscionably, a clear signal that he knew he had no case. This is great news.
