Unfortunately he can't get the death penalty, either, due to SCOTUS ruling from 10-12 years ago which tossed the death sentence of a 16 year old Arizona gang banger convicted of executing three other teens. I'm familiar with the case because my youngest sister was the prosecutor who secured the conviction and the death sentence.
No matter, he can still get life without parole. It's just a waste of money.
