Comey and the FBI have for a long time thrown around their weight. They feel as if the three letters F B I should allow them to make shit up as they go. It does not. Whiskey river is correct. They are a law enforcement agency, just like state and local law enforcement. There are Op-Orders, Policy and Procedures as well as the US Constitution and State Constitutions that every LEO has to follow and up hold.
I do like the fact that Comey is not willing to let hildabeast skate on the laws that she has broken.
That is what I like too. I heard he is threatening to resign if she isn't charged.
Say, question for the libertarian/strict construction Constitutionalists. And I'm not trolling, I'm seriously interested in how you respond to this, because it touches on quite a few other things. Simply -- do you accept the FBI as a legitimate agency of the Federal government, or do you hold that lack of Constitutional authority for it renders it ultimately illegitimate?
I can understand the need for a federal law enforcement agency, not subject to state and jurisdictional boundaries, but the Feebs are still a law enforcement agency subject to all the rules and regulations set by our constitution. They have to be held accountable just like our local law enforcement agencies, if not we would have a Hitler style gestapo making their own rules as they go.
The other side of the coin is we have a responsibility as citizens to help law enforcement officials stop those who would harm innocent people. The solution to this Apple nonsense is simple in my opinion. The Feebs can give a phone or computer to Apple. The smart people at Apple can write a code or break into the device, however they do such things, get the relevant information and turn just that information over to the Feebs. The gooberment does not get a back door program to tap into any Apple product, law enforcement has some information, maybe, that will help stop another terrorist attack. It's called cooperation and that is not a dirty word.
Egos and arrogance, especially from the FBI side of the mess, is causing the problems we see in this case. Comey needs to stick his ego in his sock and start asking Apple execs, nicely, to break into the phone in question and turn over what information is on it. If he had done so at the start of this terrorist investigation he may have already had some clues to follow up on instead of spinning his wheels, getting nowhere.

The FBI has to be there to retrieve the info. If they get it from someone else, there is a chance for reasonable doubt at trial.
It's tough to say. We are so used to having an FBI, that it's hard to see us not having one, but of late, we're so tired of seeing them do things that are politically motivated, and kow-towing to Barky, that it's making me rethink the need for them.
I just realized how little I know about Federal law enforcement. How do the US Marshals Service, Secret Service, and FBI split up the turf? Are any of them mentioned in the Constitution?
The US Marshals are charged with protection of federal judges, court houses, federal prisoner transports, fugitive arrest. The FBI on the other hand are charged with cybercrime,organized crime white collar crimes, terrorism. The FBI has 50 offices around the world.
The Secret Service main charge is to stop counterfeiting. The Marshals Service and FBI fall under the DoJ and the Secret Service falls under the Treasury. As we all know the Secret Service is charged with protecting certain elected officials. They are also charged with protect embassies and consulates that are here in the US.
