I saw that. The charge is felony murder. Capital.murder carries the death sentence. Since they also stole from the officer, I would thinkthe charge would be capital murder.
It is my understanding (which may be absolutely wrong) is that say you have a fight and shoot and kill somone. Thats murder. But if you are participating in a crime and someone gets shot, that's capital murder. The fact that the murder occurred during the commission of another crime. I suspect shooting ANY LEO would also be capital murder.
He was off duty. If the law is the same as it was when I was a lad, had Officer Allen been on duty and killed it'd be Capital Murder.
If you kill anyone it should be capital murder and be death penalty.

Nah, thats just the initial charges. I believe it is up to the DA do decide if they want to go for the death penalty provided evidence found in the investigation would support it.

Seriously, the local media (KDFW TV) is reporting that it was the Abilene PD that made the arrest. The Rangers obtained the warrant. The Abilene Police Chief said it was up to the DA and the Rangers to seek the death penalty.
In this state, murdering a police officer is a capital offense. I don't believe it matters if the officer is on or off duty.
They also make a decent baseball team.
