  • They interviewed thewoman who had been photographed in t his case. She repirted feeling "violated" after realizing the accused had stuck a camera under her skirt and photographed her. There is absolutely no other reason this would be done except for sexual gratification, but the courts claim we can't assume that was the reason for the pictures!

    • If it was without her permission then it easy to assume that AT LEAST it was something that the person believed she wouldn't like. Then it follows that if the person knew (intent) that she wouldn't like the reasoning behind his actions (or the reasons why he wanted the photo), then at least there is a possibility however tenuous that it was for his own personal and selfish sexual gratification. That is akin to rape and therefore he should be in prison. If he had the intent to share those photos with like minded people STILL without her consent, knowledge nor express permission, he is FURTHER violating her.

      He could have asked her if it was okay to take the picture up her skirt even if he chose not to disclose the reasons why he wanted the picture and leave it up to her to tell her yes or no. If she said no, then he should have respected her wishes and not take the pictures. However, that didn't happen. He did not ask, because he knew that unless she was a freak, she would say no because she would guess the reason and even just because it would be highly inappropriate. The judges in a lot of these cases are perverts themselves.

      They dispatched the FBI to investigate and probably arrest the supposed hacker of celebrities that WILLFULLY took pictures of themselves or allowed others to do with their knowledge and consent and willfully placed this photos in the cloud, but it is okay for a pervert to take a photo of someone without her knowledge nor permission and then get violated again by the court system who chooses not to protect her?

      What is wrong with this picture? If she had been a celeb would this be different?

    • People do have rights to individual thoughts they do not have the right to FORCE someone else to be part of their individual thoughts WITHOUT the person's permission, wish or assent to participate, that includes taking a picture of the woman or children (and especially children). If a woman wants to be seen as a sexual object for someone's sexual gratification in a picture she can take the picture herself and give it to the person or sell it for the person to purchase it, or she should be asked first and allowed to assent before taking the picture and if she says no she should be respected and not forced to participate in the perverts' thoughts.

      Photos are taken with the model's permission. Paintings tend to come with permission too or from the painter's imagination. Taking a surreptitious photograph is not the same thing.

      Sure people can have their dark thoughts, however disgusting, and as long as they do not act upon those thoughts the government cannot regulate those thoughts but taking a picture without permission and for the gratification of those thoughts ARE an action and therefore they are against the public interest.

      I don't believe in one law fits all either. In the case of the 12 year old girl charging her with a felony with all of those indications in place was unnecessary. She should have been punished by the school and she should be fined even, because she took the picture without permission and perhaps with desire to injure/bully but she thought better of it. Charging her was excessive.
