MAN SHOOTS, KILLS DRUNK INTRUDER WHO BROKE INTO HIS HOME AND ATTACKED HIS SON – SO WHY ARE POLICE INVESTIGATING CASE AS A HOMICIDE? We can only imagine how many rounds Ontario Police Sgt. David McBride would fire if charges by a ferocious Tea Cup Poodle.

Strictly speaking, it is a homicide -- the question is whether or not it was justifiable as self-defense. Just about any other state there would be little question at all, but of course ....
Any shooting, whether police related or not, and this is as far as I know, is investigated as a homicide until either the District Attorney/States Attorney, or a Grand Jury returns an indictment or says it is justifiable homicide. I believe most places are the same, and that is how it has been in Kalifornia for decades. If a police Officer shoots someone, three separate investigations are done including one by the state, one by the district attorney and one by the responsible agency, then it goes to the Grand Jury. If a citizen is involved as in this case, the District Attorney and the Police Agency with jurisdiction also investigate, and refer it to the grand jury.
In related news, Barack Obama is having the justice dept investigate this as a hate crime. It's obvious the resident is a racist, he didn't even try to have a mental health professional come over and counsel the intruder.
