She reminds me of all the liberal judges that sit on the bench. The criminal is misunderstood and they just need guidance. What would have the sentence been if the Border Agent had been disabled or killed?

This is the AUSA's call. Yes the Judge could reject the plea, but that generally doesn't happen unless something is way out of normal. This is not. What is abnormal is the AUSA apparently did not speak with Agent and explain how the case was proceeding. Generally if the Agent would have strongly objected, the defendant would have to plea to all charges. Unless there was some side deal about cooperation, the Agent should have consented to the plea, although the prosecutor may do as he wishes. Remember the idiot who criminally charged the two agents for shooting a drug runner in the ass? Both went to jail.
