Having read the pertinent section of the Bill (Found Here: http://thomas.loc.gov/cgi-bin/query/F?c112:2:./temp/~c112uj8own:e548990: ) I can say it's not a violation of the Bill of Rights because of at least two inclusions:
"Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States."
and
" (1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.
(2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States."
So, basically, it doesn't apply to any of us.

NDAA proponents sometimes point to an amendment to sec. 1021, added by Sen. Dianne Feinstein, as proof that the NDAA doesn’t apply to Americans. The amendment, now subsection 1021(e), states:
Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.
The key to subsection 1021(e) is its claim that sec. 1021 does not “affect existing law or authorities” relating to the detention of persons arrested on U.S. soil. If the President’s expansive view of his own power were in statute, that statement would be true. Instead, the section codifies the President’s view as if it had always existed, authorizing detention of “persons” regardless of citizenship or where they are arrested. It then disingenuously says the bill doesn’t change that view.
In fact, the Senate expressly rejected a provision that would have prevented the indefinite detention of American citizens. Sen. Feinstein offered another amendment to sec. 1021 that stated the section “does not include the authority to detain a citizen of the United States without trial until the end of hostilities.” That amendment was rejected 45-55. Sen. Feinstein’s other amendment, which does nothing to protect U.S. citizens, passed 99-1.

I think essentially what he says is that the phrase "Nothing in this section shall be construed to affect existing law," is meaningless, because existing law - and authorities - =already= recognize the power to so detain US citizens. It is far from an explicit exemption, and clarification, that US citizens are not subject to its provisions: which not only would have been a very simple qualification to write in at the beginning, as many laws do; he further notes that such =explicit= exemptions were proposed and REJECTED. For perhaps once in her career, Sen. Feinstein tried to do the right thing.

I may be stating the obvious but I don't see how this is anywhere near constitutional. In times like these I wish the supreme court had the power to strike down a law.

I have no idea if a single word of this is true nor am I a conspiracy theorist. I leave it to anyone interested to read the links if they choose. It is an interesting juxtaposition of alleged events in light of the NDAA and the Patriot Act.

It is a sad law -- but the analysis I got out of it is that the offending language doesn't revoke the existing authority already granted in the Patriot Act.
Very true, but it has always been my opinion that the Patriot Act was very UnPatriotic -- and just because the president at that time was a Republican didn't make it any better. After all, it was only a matter of time until administrations changed.
We have a lot of people in Washington hell-bent on eliminating our liberties -- of both parties. A politician that doesn't fight against this process is either a fool, or in on the scheme.
This particular signing is just Barry being feckless. That the ACLU is miffed about it? Interesting, given that they don't seem to give a damn at other times about the liberties or safety of law-abiding citizens, as long as it is their guys in charge. This flies in the face of the 1st, 4th, 5th 6th, 7th and 14th amendments. Just under a fifth of all of the amendments to the Constitution, way to go Congress and barry.

I understand that I am in the minority again (as I occasionally find myself), but as I noted in my opening comment, bills do not originate in the Oval Office. Republicans most assuredly share in the blame for this, no matter how you slice it. I think shitfart or whatever his name is mentioned McCain: not at all surprising, unfortunately.
However, the ONLY relevant question now is - what do we do to turn this around?

What you folks are seeing here is how the country will die. Not in a violent revolution where all the people who brag about how many guns they have fight the tyrannical Power That Be and their stormtroopers. But instead, we die a death of incremental totalitarianism. Check if I'm right - research how many of your rights have been swept away over the last fifty years. Imagine where you were oh, fifty or even twenty years ago and whether you ever thought you'd see some of the things you see today. Then ask yourself what it will be like here in another thirty years.
Yup, that's the phenomenon called "The Overton Window," also the title of a Glen Beck book which explores this exact scenario. Not great literature, but a good read, and a damn good alarm clock.
True Patriots are not extremists, nor quick to raise arms against a tyrant. Just like in the years preceding the Revolutionary War. It is because of Hope and Optimism and a very real desire to mold govt. not through force of arms, but with wisdom, tolerance, and Divine guidance from the Creator.
