The cop made a reasonable request for him to put the gun down, it took them 11 minutes of him refusing and them asking nicely, before they took him down.
This kid was not handling the situation correctly.
He seemed to handle it quite well in my opinion. Never got upset, never made any threatening moves, never broke a law in any way, and was very calm in the face of a bunch of armed criminals who were violating his rights. He's lucky he got it all on video. It'll help immeasurably in his upcoming lawsuit.
Hmmm....he sounds like he's maybe had a couple. And the cops are saying they've had a couple of complaints that he's pointed it at people, and THAT was the reason he was being stopped, not that he was carrying the rifle. And the one cop does make the point that he might get himself shot by other lawful carriers; not only that, he gives a substantial lecture that he and most cops believe in the right to carry.
As far as the local ordinance which may violate state law -- well, it isn't the job of police to rule on matters of law, that's what courts and judges do, and order that such a law be overturned. Cops enforce the laws that are on the books.
Bottom line -- this may not have ended the best way, or even the right way, but I can't find a lot of sympathy for this kid. The first cop told him up front to put down the gun, and he refused. Under the circumstances, I think that's a reasonable request for a cop to make. Then, the same cop says a few times he doesn't look old enough to be carrying, and the kid either won't or can't show any kind of ID. Finally -- yeah, it's San Antonio, Texas. I don't think it's the kind of place where people are going to fly into a panic over the sight of a gun and imagine things. If there were a number of complaints that he was waving it around, I would tend to give those some credibility. So, sorry, folks, but lacking any other evidence, I'm with the cops on this one.
I'd like to hear the 9-1-1 calls that claim he's waving his rifle around. One pussies waving is another persons shouldering a rifle. Far as "had a couple". He's sounds completely lucid and not slurring his speech at all. For his safety though, he should have complied with the officers.
Common sense is no longer being taught in the forces around the country. My FTO once told me the books were good to get you to me. Now it's up to me (FTO) to make sure that you learn to use common sense. It'll do more for you and your career than anything else. Best advice I was ever given and it's paid off so many times. Having been an FTO for years, there are some people that just don't have common sense, I have weeded out a few in ,my time. The scariest are the types that want to analyze everything and study it first...They often are on the wrong end of a can of whoop ass. A lot of departments that have had massive turn over now have FTO's with the minimum number of years on the job, they don't learn what they need to know before teaching others. My FTO's had an average of 20 years on the job, I soaked up what they told me like a sponge, and I passed it on. Now everybody just stands there and says do what I say, theres no communication. I learned long ago talking to someone who is being a pain in the ass or is gonna get arrested can often make it go easier, now a lot of these young guys have no communication skills and just start thumping or shooting and give the rest of us a bad name. You need more than brawn and a gun belt to do this job. Some thing lost on the new guys I am afraid.
