Okay, so after walking outside with a double barrel shotgun and firing two blasts in the air you've got to reload the gun, not a quick process. I assume even dumb criminals can count to two. Sorry Joe, epic fail.
My first thought, yea fire out a couple rounds so then your gun is empty and the bad guy now knows where you are and the fact you have an empty gun.... Joe should stick to giving advice on subjects he knows about...ahhhhh what am I talking about? In some states firing a warning shot can get you into trouble with the cops.
Every department I know of has a policy against it, we can not fire warning shots, so we shoot some piece of crap and the next thing you see in the media is the crap family demanding to know why we didn't fire warning shots or just "shoot him in the leg"..Then they always announce a car wash to raise funds for the funeral followed buy a drunken wake and a protest at the local police department. trust me I would love to fire a warning shot into the ground, but that's a no-no that can get you fired, so instead we shoot the bad guy a while bunch of times and then sit back and watch the media protest the number of rounds we used.....
To my way of thinking, if the guy's close enough to fire a warning shot, he's a threat to you or someone else and you should be totally justified shooting him. Close enough = what type of weapon he has.
Even a knife at less than 21 feet is enough to use a couple well placed rounds...A suspect can cover that distance is about second and that's just enough time to shoot. If your gonna try and hit me with a bat, pipe, bottle, or have a knife or a gun, I will shoot first, ask questions later. I don't care what malfunction you have, I am going to stop you. that's just the way it is.

I'm with Joe on this one. If I'm clearing rooms in the house at night, I'm using the shotgun. However, the 2nd Amendment allows for others to select their favorite firearm for doing the task. We need to avoid the high capacity magazine for home defense argument. Simply state that I have it because I can and you can't take it from me just because you want to.
