Therein lies our entire problem.
"No State shall ... deny any person within its jurisdiction the equal protection of the laws."
- 14th amendment to the US Constitution.
So let's apply some logic here. Penalties are supposed to be a deterrent. So if one person gets a more severe penalty than another for the same crime, is that not the State offering greater protection to one group over another?
So how are these drug-free and gun-free zones not a violation of the 14th amendment?

By that logic, hate crime laws are unconstitutional. But I have thought that for years.
That is such a great and now obvious point to my legally untrained mind. Where is our board attorney do that he can shed some judicial light on this?
It's gotta be a much shorter trip than say, the one from the 4th amendment to Roe v Wade, or the decision that struck down the anti-sodomy law (TX?), which didn't even start from the constitution, but rather from some foreign law (Saudi Arabia?, no I don't think that was it).
Been there, done that and it already has been shelved by the dem controlled house and senate in CO. There was a bill to allow people to sue business owners if they had posted self-protection free zones and didn't provide security. Got voted down by dems for this term.
Colorado isn't California, yet.
There is still hope for Colorado, not much, but as you said, they aren't California yet.
