Bird was Chief Justice of the California Supreme Court when she commuted his death sentence to life (along with others). Frankly they should have paroled Charlie and made him live with her. But she's planted now so it's too late.
It wouldn't have mattered. Even if he got the death penalty, by the time his appeals ran out, Kalifornia would have outlawed it.
