COULD THIS LAWSUIT REALLY KILL ‘OBAMACARE’? Perhaps Justice Roberts is a lot smarter than everyone thought he was. If this case wins, it knocks the whole thing out of the ballpark, not just sections.

  • Never going to happen. They only way Obamacare will be gotten rid of is when they replace it with single-payer or we one day wake up and no longer live in a nation of idiots. It's a nice thought, but let's face it, the populace will need to suffer under Obamacare for a while and when the time comes and the Democrats are arguing single-payer to fix a problem they caused, we will need to have a better and stronger argument for a healthcare system based on real free market principles (not policies the medical lobby has bought) and personal responsibility. Honestly, I'd rather we win like that then by the courts, the victory would be stronger and longer lasting.

  • Don't get your hopes up - I've read about this argument before and it was basically dismissed as a technicality that will be hemmed and hawed away by the pols and the courts. If by some miracle it ends up before the SCOTUS again, count on Roberts to fudge it away with some kind of bullshit that only he can think up.

    If ObamaCare dies and I think it will, it will be because angry voters are chasing Dem politicians down the street with pitchforks demanding they repeal it, just like with the Medicare Catastrophic Coverage fiasco in the late 1980s.

      • It has no choice but to die. It will eat away at itself from the inside and implode. The problem is what will we be left with? When this dies, we will have doctors who can't afford to practice except under the umbrella of government or "big business" that is formed by, overseen by and essentially in the pocket of government. Insurance companies will be similarly quasi-government organizations and everyone will be in the pocket of Pharma companies - that are already practically arms of the government.

        Listen - I am going through some health problems. I have been diagnosed with Diabetes 2, even though I am not overweight and I eat really healthy and exercise. I have been resisting the doctors efforts to put me on medicine, but they caught me at an unguarded moment a few months ago, and scared me into taking their prescriptions. Now I feel like I am going to die. I am injecting myself with stuff twice a day, taking pills twice a day, and I can barely get out of bed to drag myself down the stairs, much less to the gym.

        So, yesterday, I manage to get to the grocery/drugstore (and practically needed a SECOND nap of the day afterwards) and I saw the PRICES of my medicines - they were about $3,000!!! Three THOUSAND. What the (I am so close to using the F word here) heck? I understand profits - I am all for companies making profit. But the one drug - used by millions of people, every single DAY, cost $900 for the month. Do the math - that's about a billion dollars a month. THAT kind of profit, on the backs of sick people, is disgusting. I seriously want to stop the world and get off.

        That money is being used to buy and sell the politicians. It's being used to manipulate our society in ways that are bad for our society. THEY are the plantation owners and WE are the slaves, and just like the poor dumb people in the ghetto we are too blind to see it.

        • BTW, I believe it is the injectables that are making you feel like crap. I would go to another doctor and get another opinion.
          I have a friend that had a bad high blood pressure problem that was undiagnosed. When they finally found out, he isn't a "go to the Dr" type, they put him on mega meds that knocked the crap out of him! They had to keep adjusting dosage and med type until they found something that worked for him, and he is now back to work and feeling as good as ever.
          Drs have a bad habit of over medicating people when they first discover an issue.

          • The guy who just prescribed this crap IS another doctor. He is the HEAD of the endocrinology department at George Washington University. I figured if if I had to see a specialist, I would go to the best. And he IS good in the sense that he explains stuff well, but he's still just a pharmaceutical salesman, in my opinion.

            I am going to find a naturopath or something - someone who can think outside the box. These doctors are killing me!

          • My step-father was diagnosed by the head psychiatrist at a local hospital of having Alzheimer's. We were like um you don't get that practically over night. None of the other doctors at that hospital wanted to buck the bosses diagnoses. My mother finally got him to see a doctor at another hospital who picked up his thyroid was whacked. Turned out it was his thyroid, not Alzheimer's. Effing quacks.

        • OK Karmaa, a couple of questions and little info for you here.
          What was your A1c reading when they put you on the meds?
          Are you taking Metformin (pills)? What dose?
          I am diabetic, type 2 also. It seems really overkill to me that you are on both oral and injectables at the same time, and just diagnosed.
          I have been on orals for 2 years now, and have kept my sugar in check by going ultra low carb. I now only eat sugar free, no pasta, and only 1-2 pieces of bread a day. My blood sugar is now regularly between 80 and 94 and that is 2 hours after a meal. I also take 1 gram of cinnamon capsules 2x a day. It helps metabolize sugar, and is completely natural.
          If you have to keep taking the injectables, go to Wal Mart and get the generics, they are WAY cheaper than the name brand, and even cheaper than any other pharmacy I have seen. I don't take them, but have told a couple of people about the Wal Mart ones because of the savings. I had one lady that was paying $135 a bottle AFTER INSURANCE at her local pharmacy, and Wal Mart has the generics of that same stuff for $24.99 a bottle. Also, for the pills, get the generics from Wal Mart too. The Metformin is $10 for 3 months supply. My local grocery store pharmacy (Publix) gives you Metformin for FREE!!

          • Thanks hun! I am lucky to have great insurance through my husband's company. A 3 month supply of the insulin was $60, a 3 month supply of the Victoza was also $60, and the metformin was like $15 for 3 months. So, I go to the store that gives me free gas, since it's the same price for me anywhere.

            I was actually diagnosed a while ago - when I had a heart attack five years ago (and only 40 years old!!!) and I agreed to take metformin (but none of the other poisons they wanted to give me.) But what happened a few months ago is that my A1C jumped to like 10.5. And the doctor freaked out, and freaked me out, saying that I was going to lose a foot or something if I didn't start new meds.

            Anyway, I said "OK fine - I will try what the doc's say for while and see what happens". But my sugar is GOING UP, my weight is going up, and I am too freaking tired to do much of anything. So - I am right on the cusp of just telling them to screw off, and clearing their poison out of my body and enjoying whatever time I have left.

            First thing I plan to do is buy a pack of smokes, LOL!! If there is going to be poison in my body, it's going to be the poisons I LIKE - cigarettes, butter, nacho cheese doritos, bacon and maybe even a shot of tequila! Wooo hoooo!

          • My recommendation would be to cut down the dose on the insulin about 25% and see how you feel. If you're better, cut it another 10% and see what happens. I strongly believe that you are overdosing on the insulin.
            What they don't tell you about insulin is that it makes you gain weight, and it centers around the belly.
            BTW, I started gaining weight and having all these medical issues when I quit smoking! When I smoked I had no weight, blood pressure, sugar, or cholesterol problems.

          • Yeah, my poor hubby gained like 50 lb when he stopped smoking. Luckily he was really thin before, but he has a little beer belly now. And the doc is like "well, better to be heavy than a smoker". Are you KIDDING? Wait till they get him with some diagnosis - then it's ALL going to be about the weight.

          • That's exactly what happened to me. At 6'2" and 200 lb, I quit smoking, gained 50 lbs, and started having all these medical issues, none of which I had as a smoker.
            My wife still smokes, and has none of these issues. I'm almost ready to start smoking again and see if it makes me feel better!
            The reason I quit was my Dr told me I was in the early stages of emphysema. I had a friend that died from it, so it scared the crap out of me.
            BTW, don't even start about those stupid bullshit BMI charts, they're stupid as hell!

          • If you could see my wife's father who can't walk 5 feet without puffing like he ran the 100 yard dash, on oxygen, nebulizing 3 times a day, in the hospital for over a month and puffed up from taking steroids, you wouldn't start smoking again.

            My mother-in-law can't enjoy her retirement now. She's tied to him about 24x7 taking care of him. They can't travel anymore either.

          • I have family members that smoked till they died at 100+ with no ill effects. It doesn't scare me that much.

  • This is not what i was expecting, but it's a happy thought. The thing with the "tax' is that it could not be challenged until someone was forced to actually PAY it as a a tax - 2014. This scenario would be better for our country, since it could blow it out of the well before anyone has to actually pay a dime. The question I have is what other structures have been implemented already in anticipation, and how will these be rolled back. Is the insurance premium increase that my husband was hit with this year (almost 8%) going to roll back? Are the electronic records (complete invasion of privacy on every level) going to be scrapped? Unlikely. So what would the world look like if this piece of garbage was actually zapped?

    • Probably not much short-term but given the projected costs, overturning the law would save trillions we don't have and maybe provide the opportunity to return health insurance to a more free market based system.

    • you're right the damage is already done...money already spent to prep for the rules and regs...there is no undoing of the now electronic records, for example.

  • I'm skepitcal, not because it doesn't seem valid, but because it seems like the Kenyan ALWAYS seems to get what he wants. He'll find a way... the media will help him, his left leaning cronies will help him, all the demoncraps will help him, and he'll attempt to use executive orders.
