If Healthcare Law Is A Tax Is It Now Invalid? It seems that we remember something in civics class about Article 1, Section 7 that prohibits taxes from originating in the Senate. It also seems that we remember Obamacare originating in the Senate. So the question is . . . does that render any or all of this bill invalid? We won’t hold our breath though. The Constitution prohibits a majority of the things those in government do, which is why they’ve learned how to ignore it.

  • The Senate took a House Bill, gutted it, and threw in Obamacare... which means they *KNEW* it was a tax and wanted to be prepared if this came up, so they *LIED* to the American people. Open/Shut case.

  • This is the reason why (most) Forefathers and Framers wanted LESS goverment and simple laws. Why the heck do we complicate ourselves?

  • I wish that this where true. It is not, the POS started in the House, it didnt pass so what Reid did was re-work it and send it through the sent. So the technicality of it not starting in the house is not true.

    With Thursday ruling it doesn't really matter. Roberts looked for away to call it a damn tax and find it. Hell, I can find a gold bar if I look at a piece of iron long enough, or spray paint it gold.

    I've heard pundits claim that Roberts is also the keeper of the court. That is BULL SHIT. He is supposed to be the keeper of the Constitution of the United States of America. Putting faith in the SCOTUS has always been iffy at best. McCain/Feingold is one example that I can site. Roe v Wade is another.

    I’ve also heard that due to Gore v Bush Roberts felt he could not make the decision upon party lines, which is wrong too. So why did the conservative have to fall in line with the liberal section of the court? Why did Kagan even get a damn vote? She argued that the law was constitution and that it was not a tax, it was a penalty as solicitor general.

    • In other words, it was a very convoluted and screwed up path to an incorrect decision.

  • I read somewhere today that the Anti-Injunction-Act prohibits a lawsuit against a tax, until the tax has been implemented and assessed. So, is the entire case invalid, and must be retried in 2014?

  • I read some speculation about this yesterday and someone said that the House bill was substituted for the Senate one so technically, the bill arose in the House. I'll see if I can find that again and link it.
