Bet she does everything she can to be allowed to rule on this obviously unconstitutional attempt at a governmental power grab. However the E-mails are already showing she's in this up to her feces covered nose.
Kagen is not intellectually honest enough to admit she does have a conflict of interst & thay she should recuse herself. That's not how people like Kagen rise up through the ranks & gain power. My guess is she will not recuse herself, she will vote to say Obama-care is constitutional, & we will all look to Justice Kennedy...again.
This will be all everyone talks about for the next eight months (or until she recuses). Then the libs will argue that Thomas needs to recuse since his wife works at the Heritage Foundation on anti-Obamacare projects. The difference is, like Thomas, many of us have spouses and we know where they stand on issues. That is irrelevant. Kagan's role as SG should be an automatic disqualifier.
Kangaroo appointment is all she is.
