I'm not sure anything that Wilson, FDR, Johnson, or Obama strapped onto the back of the productive class is constitutional. The 18 enumerated powers are pretty much all they are "allowed" to do. It is true that the Commerce Clause has been turned into a pretzel. If Obamacare survives SCOTUS it will be so because of the CC.
