U.S. Sues BMW, Dollar General Over Use of Criminal Records in Hiring. It’s official folks. Background checks is now racists. Psssst…it just couldn’t be that both companies are non-union could it? Nah! Not with the most transparent administration…ever.

  • When is the Obummer administration going to start suing school districts? Just last week a buddy of mine applied for a janitor job at our school and he had to sign off on a background check. Our little school has a thing about child molesters working around kids so they want to know if he has ever been accused of molesting a child! Imagine that!

    All this is is gooberment sticking their nose where it doesn't belong. If I want to hire a convicted dope dealer to shovel shit out of the cow barn, that is my business. If I don't want a convicted dope dealer on my property, that too is my business. It would all depend on the person. If some guy got convicted when he was a teenager doing something stupid but had no problems with the law for years afterward I wouldn't hold it against him. Which of us around here didn't do some pretty dumb things when we were teens?

    But, it is not the governments job to make anyones hiring or firing decisions. When adults do stupid things they deserve what they get, even if it means losing their job. Unless they are a liberal they will wake up and quit doing stupid things then get their act back together.

    • How? Since I am the 1 on this board who usually goes closest to the lines of decency here, in terms of language, I would think I would be the person being censored if there was going to be any censorship, & that hasn't happened to me at any time here.

  • Wonder when the IRS/DHS/FBI and the rest of the alphabet soup go Gibson on these companies? Union membership is dropping like rocks in a water glass and the dumbass in the white-house has his minions try and reverse that, I mean they have done so well trying to reverse the damage to the economy, foreign policy, etc. Nothing more than a union hand job for Trumpka and his goons.

    • Why do you think all of the public sector hiring has been happening? Public sector unions support big gov't politicians, & provide lots of campaign money. Since that money is taxpayer money, we are paying for that.

  • This is so freaking twisted. Employers can check your CREDIT report to decide whether or not to hire you, but not your CRIMINAL background? People can get bad credit for any number of reasons. Some may be their fault, other times it's out of their control. But criminals have been caught doing bad things, and convicted in a court of law. ie: it is PROVEN that they broke laws.

    So, some poor schlub loses his job, and goes through his savings and gets in debt to keep his family going, and he can't get a job. But some crook, who stole a bundle and used that to pay their bills from prison - they can get hired? That's just not right.

    • The average IRS agent has a list of unprosecuted felonies a mile long, going back to the day they started training.

  • Not surprising at all. This administration doesn't allow trucking companies to turn down applications from drivers with a history of DWI.

    • Who cares about DWI's? As long as the driver was on his own time, in his own vehicle, I don't see what a DWI has to do with getting or keeping a job. On the job, in a truck, is a different story. They should have their CDL pulled for life.

      I know several people who had to give up driving and find another way to earn a living because they did something stupid. And I'm not talking about yesterday either, I'm talking about 5, 8, even 10 years ago, but the gooberment isn't the problem, it is insurance companies. Companies like Wal Mart, with great pay in benefits, will not hire you if you have gotten ONE moving violation in the past 10 years. If you have a DWI on record, even 30 years ago when you were 18, they will not talk to you about a job.

  • Let's see, those with prior convictions received those convictions from the government, right? So isn't it the court system that is racist?

    Seriously, this is another form of harassment by unelected bureaucrats. The EEOC witl tie up BMW and Dollar General in court for years with this. The BMW case is a bit trickier because of the retroactive nature of the terminations. The contractor changeover created that situation. Still, to insert racism into the argument is absurd. I can't say for sure if this is a pro-union over reach thing or civil rights over reach but in either case the government is telling a private employer who it can and can't hire or fire. That is way out of line.

    The Dollar General situation is easy. The government has no case, IMO. A hiring was overruled due to a company policy. Sorry but the drug dealer is SOL? Or should be.

  • When government so blatantly inserts itself into private business practices, that's a sign of the end of days. Of course it's the non-union companies - Boeing had a hard time just moving to South Carolina (they could have moved to China or Mexico easier - seriously).

    Here's why businesses don't hire criminals. It's because of liability. Employees do stupid crap sometimes & companies get sued. If that employee has a criminal record, and he gets violent with a co-worker or customer, you are screwed in court. (See: Failure to conduct due diligence)
