We can just imagine it. James Madison slipping into bed after a harrowing day of Constitution construction and dreaming happy dreams of the future republic in which agents of the state had the authority to force citizens to expose their genitals to their photographic devices.
Ridiculous you say. Madison knew nothing of modern imaging techniques. True enough. But such reasoning wasn’t enough to dissuade the DC Circuit Court from ruling that such was the founder’s intent.

In the opinion from the D.C. Circuit Court, Judge Douglas Ginsburg writes that the advance imaging technology is not unreasonable given the security concerns on airplanes, and that people have the option to opt out for a pleasurable patdown. The court notes that some “have complained that the resulting patdown was unnecessarily aggressive,” but the judges don’t seem overly concerned about that. Ginsburg writes:
“On the other side of the balance, we must acknowledge the steps the TSA has already taken to protect passenger privacy, in particular distorting the image created using AIT and deleting it as soon as the passenger has been cleared. More telling, any passenger may opt-out of AIT screening in favor of a patdown, which allows him to decide which of the two options for detecting a concealed, nonmetallic weapon or explosive is least invasive.”
So it’s either an invasion or your privacy or an invasion of your privates. According to Judge Douglas Ginsburg this excellent choice is all yours.

I wonder if he saw that in the Commerce Clause. That's where these a-holes see all their wonderful statist fantasies.
Evedrything that they want, and can't find anything in the Constitution to support it, magically appears in either the Commerce Clause or the General Welfare Clause.
Problem is, they never read beyond the title of the clause to see what it really means.
Sad, but true, Poppa.
He's sees no inherent problems regarding the rights of passengers with respect to these invasive techniques probably because he's never going to have to undergo these aggressive techniques next time he boards a plane...private jet. I hate and despise progressives with every fiber of my being, that includes the "O". Being possible that she's never taken a flight in the last five years, she's never been subjected to this crap and therefore, thinks all this shit is just hunky dory. Bet!
I want to see what part of the constitution he cited. The 4th amendment guarantees the right not to be subjected to ILLEGAL searches and seizures, so where in the Constitution does it say a TSA employee can do a search with out probably cause.
Being a duly sworn officer, if I don’t have probably cause to make an arrest or frisk someone, the lawyers come out of the wood works wanting to sue me, the agency and the city. So now some robe wearing person with an agenda says it’s ok for someone to put their hands on me or someone else just to board a plane while letting those of Middle Eastern Decent walk right on by. Thank you ACLU and Southern Poverty League.
It’s time to wake up and take the air ways and air ports back from the “want a be cops” and the buffoons in charge of it all. Check how El Al air does it. The Israelis have it down to a science and it can be done here. It’s just that the unions want to protect their turf and their allies in congress have no problem doing it for them.
TSA, another group slated for extinction when I become Dictator-In-Chief!
Ok, since the page won't allow me to click the thumb up, here it is, Hisham.
Thanks for the thumbs up RHG. Send money for my presidential campaign to: hishamfordictatorinchief@myblog.org. Thanks! :-)
BTW, it isn't a real site and I'm not running for anything (just being transparent's all).
RIM--That was mean--to all those elementary school crosswalk workers!!!
RIM, I was thinking along the same lines, but was going to suggest hiring Israeli Airport Security to come here and work, then they could train our TSA drones how to do it right!
Funny how Israel hasn't had one hijacking since they started profiling, and very few people are subjected to invasive searches!
Precisely!
Allow profiling and this issue would never be one. Oh, and hire people with actual security credentials for TSA. Some of these folks look better suited for elementary school crosswalk duty. Sorry, that may have been a little mean, but really! We should send our TSA recruits to Israel for training, or better yet, only hire those that HAVE gone to Israel for training.
So, since safety is our main concern, how far away are we from the TSA requiring us to drop our drawers, bend over and spread our a$$ cheeks. Seems to me that if we REALLY want to be safe, full cavity searches are warranted.
I'm sure Judge Ginsburg would agree.
Don't you dare give this f***er any ideas!
Sounds like the judge might like it.
Strychnine or arsenic? I just love the choices Progressives give you.
I think that we men should make a concerted effort to assist the TSA in making sure we aren't carrying any dangerous weapons. Just "go commando", and request the pat down. When you get to the pat down area, merely drop your pants so they can see you are unarmed! This can be done quickly and easily, due to the fact that you have already removed your belts or suspenders, so as to avoid setting off the metal detector.
It will also save them time groping, um, patting you down, as they can clearly see everything they need to! The lines will move along much quicker that way.
Ha ha, or go in and talk with a really faggy seductive voice and ask if that big handsome agent over THERE would do the patdown. Betcha that'll keep things moving!
"…any passenger may opt-out of AIT screening in favor of a patdown, which allows him to decide", said the moron.
And as Jerry Clower would have said, with the option of whipping all them dogs & walking away, the raccoon has a sporting chance.
Unfortunately for us, that judge isn't trying to be funny.
