Supreme Court Turns Away Appeals From Schools in Title IX Cases. School boards can’t hide anymore. We hope they get it good.

The United States Supreme Court will not hear an appeal from a Virginia school board arguing that it should not be held liable under Title IX for an alleged sexual assault of a classmate by another classmate on a school trip.

On Monday, the court rejected the appeal from the Fairfax County School Board. The case will go to trial in federal court in Alexandria, Virginia. 

According to the Associated Press, the case turned on whether a school system can be held liable under the civil rights legislation Title IX for a single alleged assault when there had been no notice of a problem.

The charges against the high-profile lawmaker come a day before the start of a special session of the General Assembly on COVID-19 and police reform. Democrats hold a 21-19 edge in the Senate, and if Lucas is absent, it could threaten parts of the Democrats’ agenda.

The Washington Post likes Creigh Deeds, Virginia’s Democratic nominee for governor. Actually, they may not be all that crazy about Deeds, but they hate-hate-hate Bob McDonnell, his Republican opponent.

In fact, they hate McDonnell so much that they actually find a way to heap praise on Deeds for his hilarious habit of taking both sides of every argument.

To supporters, his capacity for change suggests the promise of his leadership: that, never having been wed to ideology, he is capable of responding even-handedly to the array of economic and social challenges facing Virginia. To his skeptics, the trait merely evinces Deeds’s habit of trying to appeal to different constituencies by saying “yes” and “no” to the same question.

We agree with that analysis. Of course, we also disagree with it.

On July 16, Biden visited Richmond, Virginia to deliver the same message of hope and change. The next day, the Bureau of Labor Statistics revealed that Virginia shed 22,800 in June and that the state’s unemployment rate had jumped to 7.2%.
