Obama himself said one of the Talban Five was too dangerous to release. Three years ago, the Obama administration went to court to argue that Khairulla Said Wali Khairkhwa should be denied habeas corpus because of his Taliban leadership position and because he was “‘directly associated” with al-Qaeda. The judge agreed and ruled accordingly. So the White House went against themselves, against Congress, and against a judge’s ruling.
