Goodwin Liu was nominated for the Ninth Circuit Court of Appeals by President Obama. Liu’s such an extremist that even a considerable number of Democrats opposed the appointment. As a result, Liu’s nomination went down in flames on Wednesday.

The majority leader in the United States Senate doesn't understand what his duties are

Let’s go to Senate majority leader Harry Reid for a comment via NetRight Daily:

Liu was nominated by Obama in 2010 and again in 2011for a seat on the Ninth Circuit Court of Appeals. The Senate Judiciary Committee had approved him by a vote of 10-8. Had Liu been confirmed by the Senate, many expect that he would have eventually been promoted to the Supreme Court.

As Harry Reid noted of Goodwin Liu after meeting with him, “The court of appeals is where law is made, and we need the finest minds in the world for that.”

We’re looking for volunteers. Who’d like to tell Harry that the courts are supposed to interpret the law and the legislature is supposed to make it?

You know, the legislature. The part of the government in which Harry Freakin’ Reid has served for 25 years.

Angle seemed to be a person with the right principles, but no ability to campaign. No people abilities. The indelible mark of her campaign last year was a video shown on TV where she was walking away from the camera with her husband, saying over and over “No comment.” No comment? WTF!? Lady, you’re running for office against the Majority Leader of the U.S. Senate! When you see a man with a camera, stop and walk TOWARD the camera!

Given the brilliance evidenced by our political leaders and our media, is it any wonder our kids are completely ignorant? Too sad. Such WONDERFUL examples they provide. I want to go back to where the delinquents were not the heroes and the goal at school was to do as well as possible. I honestly wonder why ANYONE (even kids) go to school anymore. It is clear they aren’t learning anything and we are paying a fortune for babysitting.

Most of the dip-shits in both houses of Congress have no idea what our government is comprised of, the branches and their duties, the fact that we aren’t a “Democracy”, (rather are supposed to be a Democratic Republic), etc.
I am not surprised by this rocket scientist’s take on how our government works-he and his son have engaged in so many illegal activities in Nevada it is sick.
He has never had a real job in his life-outside politics-yet is a multi-millionaire. Go effing figure how that works.
Tar/Feather him, and put him in stocks right on the strip for all to come by and pelt him with various rotten foods!

Guess Harry didn’t pay attention in civics class, law school and he sure as hell has not paid attention to the US Constitution. This statement alone should be enough for a recall election for the people of Nevada.

The court of appeals is to review lower case rulings and determine if there where errors in the judges rulings and findings. However, if you are a senile old senator from Nevada or a communist member of the Democratic Party then you want the courts making laws that you can not get passed through the legislator.

Well this comes as no surprise. The biggest threat to liberalism is elections and when you shift law making power from elected officials to unelected officials it allows for the rampant implementation of ideology without consent of the American people. All the elected officials have to do is pass vague laws and allow them to be interpreted by their stacked courts in a way that fits their agenda. Constitutional or unconstitutional, it does not matter.

This is another example of why it’s not just about putting Republicans in office, but rather putting people in office that will fight to give power back to its rightful owners, the American people.

Chuck Schumer thinks the 3 branches of government are the president, the house and the senate. Harry Reid thinks the Court of Appeals is where law is made. President O thinks there are 57 states and wants to learn Austrian so he can converse with Austrians in their native tongue (I guess his corpseman didn’t tell him about the Teutonic shift that occurred whereby the Austrians mostly speak German.) Oh, and Joe Biden remembers FDR announcing the stock market crash on TV in 1929 (probably in that restaurant he eats at so often, the one that’s been closed for 20 years.)

And WE’RE the ones that are stupid and uneducated.

Just like Constitutionality flows from SCOTUS work beyond the words of the Constitution itself.. Remember, even the power of “judicial review” isn’t explicitly granted to SCOTUS.. It is strangely a power that SCOTUS granted itself early in republic

While the courts affect and interpret laws, I would think it strange that a man in the organization explicitly defined as having the capability of making laws would even say such as Harry did. It constitutes encroachment upon his territory, and last I heard, Harry doesn’t put up with that. It’s an indicator of what strategy they will adopt should they become the minority.

More legislative hypocrisy, much like has happened with judicial filibusters: “OK when *we* do it, not OK when *you* do it.”

I’d like to throw every single one of the bums out from both parties and start over, using a lie detector and a ball bat for my selection criteria.

I just think he knows that when a matter of law is being disputed in the courts, the courts review both the legislation *and* preceding rulings regarding that law. Courts of sufficient authority will address constitutionality at both state and federal levels. The law, in force, emerges out of its original legislation (statuatory), the policy and regulations determined by executive/enforcement agencies, and the accumulation of a succession of court rulings.

I’m mostly an ignorant schlub, but if I can credibly argue about these distinctions within “law”, then its easy to imagine a law student or a legislator recognizing the same (even if there are debates about variations in the way Law should play out)

I agree with you a reboot would be ideal. Both parties rail against the tactics of the other when they are on the losing end. I’ve seen these reversals enough times in my life to suitably ignore the bleating. This even goes beyond balance-of-power or legislative tactics into fundamentals like war (My Guy’s War is Just, Your Guy’s Very Similar War is an Abomination). As always, I find the partisan tribalism worrisome

Yah, we’re talking semantics here. While the process you described *is* how it works, the most apt term is *interprets*, rather than *makes* the law. While they have the latitude to “flesh out” certain ambiguous portions of the law, they don’t have the latitude to go filling in the blanks at will. While Harry may have been dumbing down his speech for world+dog, I have my doubts — he’s a lawyer, and a shrewd one. It pays to watch every word out of a politician’s lie-hole.

Telling the judges on the 9th Circuit that they “make” laws creates the impression of giving them latitude to formulate laws per se out of whole cloth, ideology, and intentions. Even if they weren’t to get “ideas” about their new roles, the people get the idea, and that’s a Very Bad Thing, given that we as a public have bought into a false narrative of the roles of judges.

Somewhere we lost our way in evaluating judges, and instead of looking for them to be fair and impartial, we look to stack courts like this and SCOTUS with judges who echo our political ideology. The end game is a lack of credibility very reminiscent of that in certain corruptocracies. Are we a nation of laws or a nation of strongmen and ideologues?

I’ve noticed a pattern in the partisan tribalism. Regardless of which party creates the incursion on our rights and freedom, the net loser is always freedom/the people and the net winner is always statism/big government. I don’t notice many incursions done by X party actually being *repealed* by Y party — instead, both have an established pattern of taking the new status quo and enlarging upon it. All political howling aside, the ones that really need to howl is us.

According to Harry, the court IS where the law is made, and besides, it’s a “living constitution”, meaning that all those assigned duties such as legislating and interpreting law, are all flexible and can be bent and shifted as necessary.

Not sure if this was really Harry showing himself to be a moron or a pernicious little snot showing his true colors.
